For this paper use the data from Tables 6.1 and 6.2 in the Carp text book that were in Lesson 5 along with the data in Table 12.1, part of the discussion in the book dealing with “The Democratic Subculture” and its effect on judicial decision making, to examine the influence of politics (the Democratic Subculture) on how judges decide cases. Table 6.1 on pages 119-120 provides data on the background characteristics of the federal district court judges appointed by presidents Reagan to Obama. Some striking differences in appointments are revealed in these data. For example, only 8.3 percent of the judges appointed by President Reagan were female as compared with over 50 percent of those appointed by President Obama. Other differences in the characteristics of federal district judges appointed by these presidents appear in the chart, such as the strong correlation between the political party affiliation of the appointing president and that of the people chosen to serve on the federal bench. After describing in detail these, and other, patterns found in Tables 6.1 and 6.2 discuss what you think explains these differences.
Chapter 12 in the Carp text book addresses decision making in trial courts. Table 12.1 in this chapter analyzes the differences in the kinds of decisions made by federal district judges. As this table shows, judges with Democratic and Republican political backgrounds sometimes differ in the kinds of positions they support in their decisions on the bench. Your paper should provide illustrations of these differences.
The paper assigned in Lesson 13 should synthesize the information drawn from these various tables by examining how the democratic subculture affects judicial decision making and specifically the logic that connects the politics of judicial selection with the choices judges make in their decisions. The first two pages of your paper should clearly discuss the differences between the legal and democratic subcultures as described in the Carp text book. Be specific about how the democratic and legal subcultures differ and discuss the important characteristics of each one. Provide examples from the Carp text book, such as Judge Mize’s decision in Evers v. Jackson Municipal Separate School District (1964)Links to an external site., a case that is both enlightening and disturbing at the same time and illustrates the interplay between the legal and democratic subcultures. Your essay should then draw upon both specific details from the data found in the tables noted above and the discussion found in the Carp text book.
